General Terms and Conditions (GTC)

  • 1. Scope of Application

    These General Terms and Conditions (hereinafter “GTC”) apply to all legal relationships of Weseta Textil AG, Bergen 4, 8765 Engi / Glarus Süd, Switzerland (hereinafter “Weseta Textil”) for the purchase of goods from the Weseta Textil range via the online store at the URL www.weseta.com/en-ch/shop/ of Weseta Textil (hereinafter “Weseta Textil online store”). Weseta Textil provides its services exclusively on the basis of these GTC. Deviating terms and conditions of the customer as well as amendments and supplements to these GTC shall only be valid if they have been recognized in writing by Weseta Textil. In these cases, these GTC shall apply in addition.

     

    2. Product Range

    Weseta Textil’s current product range can be found at www.weseta.com/en-ch and in the periodically updated Weseta Textil brochures. This information is of a descriptive nature. The offer contained therein is non-binding. The product range and the offer are subject to change by Weseta Textil at any time. The information in the Weseta Textil online store (e.g. product descriptions, illustrations, sizes and other information) does not represent any assurance of properties or guarantees, unless explicitly stated otherwise.
    The color values are displayed in the Weseta Textil online store as true to the original as possible. The original product may differ from the color values in the Weseta Textil online store.

     

    3. Prices

    The prices/currency in effect at the time of order will apply. All prices for the goods stated in these GTC, in the offer, in the order confirmation and in the contract are to be understood as prices including the statutory sales tax rate.

     

    4. Registration / Data Protection

    In order to complete an order process, the customer must register on the Weseta Textil website with their personal details. The customer undertakes to provide truthful information. Weseta Textil reserves the right to delete a customer account at any time without giving reasons.

     

    Weseta Textil attaches great importance to the protection of your data. The details can be found in the separate privacy policy.

     

    5. Binding Nature of the Order

    The offer on the Weseta Textil online store is deemed to be an invitation to submit an offer. As soon as Weseta Textil has received the customer’s order (by telephone, e-mail, etc.), this is deemed to be an offer. The contract is concluded with the order confirmation by Weseta Textil. The order confirmation will be sent by e-mail. If Weseta Textil does not confirm the order within 5 days, the customer is no longer bound to their offer.

     

    Deviating from this, a contract is concluded:

    • in the case of payment via PayPal, at the time of confirmation of the payment to PayPal;
    • in the case of payment by TWINT, at the time of confirmation of payment to TWINT;
    • in the case of payment by credit card, at the time the credit card is charged.

     

    6. Payment Methods

    Payment can be made by invoice, prepayment, PayPal, TWINT, credit or debit card.

     

    6.1 Purchase on Account

    With us, you can pay for your order conveniently by invoice even after receiving the goods. You will receive the invoice separately by e-mail, which must be paid within 14 days of the invoice date (due date).
    The purchase on account is processed by CembraPay AG. The  CP GTC (cembrapay.ch) and the privacy policy of CembraPay AG (cembrapay.ch)  apply, which in particular also provide for the possibility of a credit check. Weseta Textil reserves the right to exclude payment by invoice at its own discretion and without giving reasons.

    Purchase on account is not possible in the following cases:

    • The delivery address does not match the billing address.
    • Invoice amounts from another order are still outstanding.
    • Your shopping cart exceeds a value of CHF 1,000.00.
    • It is not possible to order gift vouchers on account.

     

    6.2 Advance Payment

    In the case of advance payment, delivery will only be made after receipt of the full payment.

     

    6.3 Payment by Credit Card

    You can also pay conveniently and securely by credit card. We accept the credit cards listed in the Weseta Textil online store. If you return ordered goods, the value will be refunded to your credit card. Your credit card details are transmitted in encrypted form. This high standard of security means that shopping at Weseta Textil by credit card is safe.

     

    7. Delivery Times / Delivery Costs

    7.1 Delivery times

    Weseta Textil offers the products subject to availability. If a product is unavailable, the customer will be informed as soon as possible in a suitable form. Weseta Textil reserves the right to withdraw from the contract if products are no longer available through no fault of Weseta Textil. Delivery takes place within 14 working days. Longer parcel delivery times must be expected before public holidays (Easter, Christmas). Weseta Textil will point this out during order placement.

    In the event of temporary delivery delays for which Weseta Textil is not responsible (“force majeure”, in particular war and warlike conditions, strikes, sabotage, epidemics and pandemics, late delivery to Weseta Textil), Weseta Textil shall be released from the obligation to perform for as long as the obstacle exists. In these cases, the customer is also not obliged to reciprocate. Payments already made will be refunded immediately. If Weseta Textil is unable to deliver within four weeks, the customer is entitled to withdraw from the contract. Further legal claims of the customer remain unaffected.

    Weseta Textil is entitled to make partial deliveries, insofar as this is reasonable for the customer. In the case of partial deliveries, Weseta Textil shall bear the additional packaging and shipping costs incurred.

     

    7.2 Delivery Costs

    The flat-rate shipping costs will be displayed before the order is completed and shown separately on the invoice / order confirmation.

    Weseta Textil is not liable if the goods cannot be delivered or are delivered late due to incorrect delivery address information provided by the customer or the absence of the recipient.

     

    8. Maturity

    The customer is obliged to pay the purchase price within 14 days of the invoice date (date of maturity).
    After expiry of this period, the customer shall be in default without the need for a reminder. For reminders sent by Weseta Textil during the period of default, reminder fees shall be charged in the amount of the actual costs incurred.
    The delivered goods remain the property of Weseta Textil until the purchase price has been paid in full.

     

    9. Right of Return

    You can return/exchange regular items within 14 days of receiving your order, provided they are received undamaged and in their original packaging with product labels.
    Discounted items cannot be returned/exchanged except in the case of faulty deliveries by Weseta Textil.
    Custom-made products, such as bath mats made to order and personalized items, cannot be exchanged or returned. Such items can only be refunded in the event of a production or delivery error. In such cases, please contact our Customer Service team directly at shop@weseta.ch
     
    Return and exchange of regular goods
     
    If you wish to exchange or return an item ordered from weseta.com, please refer to the relevant instructions in the Weseta Textil online store.
    Weseta Textil will pay the shipping costs for your return in accordance with the information in our Weseta Textil online store. Refunds or exchanges will be made after careful inspection of the goods by Weseta Textil. Items that have been used, modified or damaged will not be taken back. The seams and labels on the product must be undamaged. Weseta Textil reserves the right to refuse the return of goods which, at the sole discretion of Weseta Textil, do not meet the above-mentioned return requirements.
    You will be informed about the current status of the return. Weseta Textil accepts no liability for reimbursement or compensation in the event that the return package is lost, stolen or mishandled.


    Any refund amounts are paid to the method of payment used for purchase.
    Please note that shipping costs charged for the order are non-refundable in the event of a return.
     
    Faulty delivery / defective items


    Faulty deliveries by Weseta Textil will be replaced in full. We cover any additional shipping costs. This regulation also applies to discounted goods.
    Defective items (damaged goods on delivery / quality defects) will be carefully checked by us and also replaced in full, including shipping costs for the new delivery. However, Weseta Textil reserves the right to refuse replacement if it is determined that the damage was not caused by Weseta Textil. This regulation also applies to discounted goods.

     

    10. Intellectual property

    All rights to the website, the Weseta Textil online store and its content, products, logos etc. are either the property of Weseta Textil or have been licensed to Weseta Textil by third parties. Weseta Textil or the licensors of Weseta Textil are exclusively entitled to existing intellectual property rights such as copyrights, trademark rights, etc. This content may only be used by customers in connection with the use of the website or the online store and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, presented, licensed or used for any other purpose without the prior written consent of Weseta Textil.

     

    11. Final Provisions

    We save the text of the contract and send you the order data by e-mail after the order has been placed.
    The contractual relationship with the customer is governed by Swiss substantive law. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
    Irrespective of this choice of law, consumers who have their permanent residence in a member state of the European Union at the time the contract is concluded may also invoke the mandatory consumer protection provisions of their country of residence.
    If the customer is a merchant, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered office of Weseta Textil AG.
